- INTERPRETATION
In this agreement:
“CPA” means the Consumer Protection Act, 68 of 2008 (as amended from time to time).
“CPA Customer” means any Customer whose asset value or annual turnover is below R2,000,000.00 or the gazetted CPA threshold, as amended from time to time.
“Customer” means any person or entity purchasing goods or services from Rugged SA.
“Goods” means the products and/or services supplied by Rugged SA as reflected on invoices, quotations, orders, or delivery notes.
“Day” means any day other than a Saturday, Sunday, or public holiday in the Republic of South Africa.
This agreement applies to every contract of sale between Rugged SA and the Customer, whether oral or written.
- CONSUMER PROTECTION ACT COMPLIANCE
These Terms include provisions that may: (a) limit the risk or liability of Rugged SA or a third party; (b) create risk or liability for the Customer; (c) compel the Customer to indemnify Rugged SA; or (d) constitute an acknowledgement of certain facts. Such clauses are highlighted for emphasis as required by the CPA. Nothing in this agreement is intended to unlawfully limit any rights under the CPA. If you qualify as a CPA Customer, the specific protections under clause 13 (Warranties & Indemnities – CPA Customer) will apply to you.
- ONLINE STORE TERMS
By using this website, you confirm that you are the age of majority in your province or have given consent for minors to use this site. You may not use our site or products for any illegal purpose, nor may you transmit malicious code, viruses, or data of a destructive nature. Violation of these Terms may result in the immediate termination of access to our Services.
- PRICES
4.1 Prices quoted are based on costs at the time of sale, including materials, labour, transport, customs, and exchange rates. Prices may change without prior notice.
4.2 Prices exclude VAT, which must be paid together with the purchase price.
4.3 Rugged SA reserves the right to amend prices at any time prior to delivery.
4.4 The Customer agrees to Rugged SA’s standard rates, available upon request.
- PAYMENT
5.1 Payment must be made immediately upon invoice and before delivery.
5.2 Payments must be made by cash or EFT and will only be deemed received once cleared in Rugged SA’s bank account.
5.3 Orders will not be released or delivered until full payment is confirmed.
- ORDERS AND QUOTATIONS
6.1 Orders may be placed in writing, online, verbally, or via sales representatives.
6.2 Any quotation is an invitation to do business, not an offer.
6.3 A binding contract is formed only when Rugged SA accepts an order in writing.
6.4 Quotations may be withdrawn at any time.
6.5 Orders are subject to product availability.
6.6 Cancellation of an accepted order may result in Rugged SA charging the full purchase price if the goods have been ordered from suppliers.
6.7 The Customer must provide a valid order number and delivery address.
- DELIVERY
7.1 Goods will be delivered to the nearest accessible point at the address provided by the Customer.
7.2 Offloading is at the Customer’s sole risk and cost.
7.3 Risk in the goods passes to the Customer upon delivery or collection.
7.4 Rugged SA will use best efforts to deliver on time but shall not be liable for delays.
7.5 If delivery is delayed or refused by the Customer, risk passes immediately and storage/handling costs may apply.
7.6 A signed delivery note constitutes proof of delivery.
7.7 Any shortages must be noted on the delivery documentation at the time of delivery.
- OWNERSHIP AND RISK
Ownership of goods remains vested in Rugged SA until full payment is received. Risk passes to the Customer upon delivery or collection.
- RETURNS
9.1 Returns will only be accepted with Rugged SA’s prior written consent.
9.2 A minimum 10% handling fee applies, and goods must be in original packaging and undamaged.
9.3 The Customer is responsible for all return transport costs unless otherwise agreed.
9.4 Returns must be authorised by an appointed Rugged SA representative or director.
- PRODUCTS AND SERVICES
10.1 Certain products may be sold exclusively online and in limited quantities.
10.2 Product descriptions and images are for reference only. Colour or appearance may vary.
10.3 Rugged SA reserves the right to limit or discontinue any product at any time.
10.4 No guarantee is given that any product will meet a Customer’s specific purpose or expectations.
- ACCURACY OF INFORMATION
We endeavour to provide accurate, current, and complete information. However, Rugged SA shall not be held liable for typographical or factual errors and may correct or update content at any time without notice.
- WARRANTIES & INDEMNITIES (GENERAL CUSTOMERS)
12.1 All goods are sold voetstoots (as is), unless otherwise stated in Rugged SA’s Standard Warranty Terms.
12.2 Rugged SA makes no warranties or guarantees not expressly included in this agreement.
12.3 Liability for defective goods is limited to repair or replacement at Rugged SA’s discretion, provided notification is received within the applicable warranty period.
12.4 The Customer indemnifies Rugged SA from any third-party claims arising from the use or resale of goods.
12.5 Rugged SA will not be liable for indirect, consequential, or special damages, including loss of profits.
- WARRANTIES & INDEMNITIES (CPA CUSTOMERS)
13.1 Rugged SA’s liability for defective goods is limited to: (a) repair or replacement of the goods; or (b) refund of a reasonable portion of the purchase price.
13.2 Returns must be in original packaging and condition.
13.3 Rugged SA reserves the right to inspect returned goods for misuse or negligence, which may void the warranty.
13.4 Returns for defective goods will be at Rugged SA’s cost.
13.5 The CPA warranty runs concurrently with the Supplier’s standard warranty.
13.6 The CPA Customer indemnifies Rugged SA from any third-party claims.
- DELIVERY AND SHIPPING TERMS
Shipping details are outlined on our Shipping Details page. By placing an order, you agree to these terms. Shipping terms may change without notice, and it is your responsibility to review them before ordering.
- DISCOUNT CODES, VOUCHERS AND POINTS
15.1 Discount Codes & Vouchers:
– Valid only on online purchases of R1,000 or more.
– One code per customer/order.
– Not applicable to items already discounted.
– Cannot be combined with other promotions.
15.2 Points:
– Customers earn 5% back in points on online orders.
– Maximum 10% of total points can be used per order.
– Points expire after 12 months.
– Points are redeemable exclusively for online EFT payments and not for enterprise deals.
- ONLINE SALES / SPECIALS
Discounted items are limited to two (2) per customer. Discounts apply only to online or in‑store purchases. Manual orders are charged at standard retail prices.
- RIZZEN COMBO DEAL TERMS
Installation voucher valid for 3 months and in Gauteng only. Voucher applicable only for Rugged SA–accredited installers. Purchases must be made online during August 2023. Provide your invoice number and voucher to qualify for the discount.
- BREACH OF AGREEMENT
If either party breaches these terms and fails to remedy such breach within 7 (seven) days of written notice, the aggrieved party may cancel the contract and claim damages or specific performance.
- GENERAL PROVISIONS
19.1 This document constitutes the entire agreement between Rugged SA and the Customer.
19.2 Any variation must be in writing and signed by an authorised Rugged SA director.
19.3 No indulgence or relaxation shall constitute a waiver of any rights.
19.4 The Customer may not cede or assign its rights or obligations.
19.5 Rugged SA may recover all legal and collection costs incurred in enforcing its rights.
19.6 This agreement shall be governed and interpreted in accordance with the laws of the Republic of South Africa.

Terms and Conditions
Please read these Terms and Conditions (“Terms”) carefully. By participating in this competition, you agree to be bound by these Terms.
1. The Promoter
The promoter of this competition is Rugged SA (referred to as “the Promoter”).
2. Competition Period

The competition will run for a total of 3 (three) weeks.

The competition starts on Thursday, 23 July 2026 and closes on, Thursday, 13 August 2026 (“the Competition Period”).

The weekly entry periods are structured as follows:

3. Who Can Enter (Eligibility)
To enter this competition, participants must:

Be a natural person residing in the Republic of South Africa.

Possess a valid South African Identity Document or permanent residency permit.

Be 18 years or older, or have parental/guardian consent if under the age of 18.

Exclusions: Directors, members, partners, employees, agents, or consultants of Rugged SA, Rizzen, or any associated promotional/marketing agencies, as well as their immediate family members, are not eligible to enter.
4. How to Enter

To stand a chance of winning the tablet allocated for any given week, participants must meet the specific entry requirements designated for that specific week.

Requirements for each week will be clearly posted on Rugged SA’s official channels at the start of each weekly period.

Participants must complete the weekly requirements within the designated week’s start and end times to be entered into that week’s draw.
5. The Prize

There are 5 (five) Rizzen Q1 Smart Tablets to be won in total.

One (1) winner will be selected for each of the 5 weeks.

The prize is non-transferable, non-negotiable, and cannot be exchanged for cash or any other product.
6. Winner Selection & Announcement
-
Selection: One winner for each week will be randomly selected from the pool of eligible entries that successfully met that specific week’s requirements.

Announcement: The winners for all 3 weeks of the competition will be announced simultaneously in the final week of the competition (Week 3) on Rugged SA’s official social media platforms and/or website.
7. Claiming Your Prize
⚠️ Strict 3-Day Claim Rule: Winners will have exactly 3 (three) consecutive days from the date of the announcement/direct notification to claim their prize.
To claim the prize, the winner must email the following details to sales@ruggedsa.co.za:

Contact Information (mobile number and alternative email address)

Forfeiture: If a selected winner fails to email the complete and correct details to the specified email address within the 3-day window, they will automatically forfeit the prize.

In the event of forfeiture, the Promoter reserves the right to randomly draw a new winner for that associated week’s prize under the same terms.
8. Protection of Personal Information (POPIA)

By entering this competition, participants consent to Rugged SA collecting and processing their personal information (Name, Contact Details, Address) for the sole purpose of administering this competition, contacting winners, and facilitating prize delivery.

All personal data will be processed in strict accordance with the Protection of Personal Information Act, No. 4 of 2013 (POPIA) and Rugged SA’s Privacy Policy.
9. General Terms

The Promoter’s decision regarding the selection of winners and any disputes is final, and no correspondence will be entered into.

Rugged SA reserves the right to amend, postpone, or cancel the competition and its prizes (or any aspect thereof) at any time without notice, in the event of circumstances beyond its reasonable control.

Rugged SA, its affiliates, and sponsors accept no liability for any damage, loss, injury, or disappointment suffered by any entrant participating in this competition or as a result of accepting the prize.
