PRELOVED AND UNBOXED DEVICES
- CONDITION DISCLOSURE AND ACCEPTANCE
All preloved, demo, refurbished or unboxed devices (“Preloved Devices”) are sold in the condition expressly disclosed by Rugged SA at the time of sale. The Customer acknowledges that:
(a) such devices may show signs of previous use, wear, or packaging variance;
(b) Rugged SA has disclosed that the device has cosmetic defects;
(c) the Customer has accepted the goods on that basis. Accordingly, these products are sold voetstoots (as is), subject only to any limited warranty expressly provided in writing.
- NO RETURNS FOR CHANGE OF MIND
Pre-loved Devices may not be returned merely because they are “unwanted” or the Customer has changed their mind after purchase, provided that Rugged SA accurately disclosed their condition at the time of sale. Returns will not be accepted where the goods conform to the disclosed and accepted description.
- WARRANTY ON PRELOVED DEVICES
- Unless otherwise stated in writing, Preloved Devices carry a limited 3-month repair warranty covering functional defects not disclosed prior to sale.
- This warranty excludes:
– wear and tear, cosmetic blemishes, or minor defects disclosed and accepted by the Customer;
– damage caused by misuse, neglect, unauthorised repairs, or modification;
– consumable components such as batteries, screens, or cables unless specifically warranted. - The Customer must notify Rugged SA of any functional defect within the warranty period.
(d) Rugged SA’s liability is limited to repair, replacement with an equivalent unit (if available), or refund of a reasonable portion of the purchase price, at Rugged SA’s discretion.
4. CPA COMPLIANCE AND LIMITATION
In terms of section 55(6) of the Consumer Protection Act, the statutory warranty of quality does not apply to defects that were specifically disclosed to and accepted by the Customer prior to sale. Rugged SA will ensure that all such disclosures are made in clear and understandable language prior to sale or checkout.
5. INSPECTION AND TESTING
The Customer is encouraged to inspect and test any Preloved Device prior to accepting delivery or collection. Once accepted, the Customer confirms that the device corresponds materially with the disclosed condition and functionality.
6. UNBOXED DEVICES
Unboxed or demo units are sold as new devices that may have been opened for display or inspection. Such units remain subject to Rugged SA’s standard new product warranty unless otherwise stated in writing. Minor packaging or aesthetic variances do not constitute defects or grounds for return.
7. RETURN PROCEDURE
Any return of a Preloved or Unboxed Device must be authorised in advance by Rugged SA in writing. Returns without prior authorisation will not be accepted. Rugged SA reserves the right to inspect all returned devices and to reject any claim inconsistent with these Terms.
RUGGED SA: PRE‑LOVED (“AS IS”) DISCLOSURE AND ACKNOWLEDGMENT
This disclosure is designed to comply with the Consumer Protection Act, 2008 (CPA), including Sections 55 and 56. It must be presented prominently to the consumer before purchase, and the consumer’s acknowledgment obtained.
1. Condition & Known Defects Disclosure
This product is a pre‑loved / used device. It has been previously owned and may show cosmetic wear. Rugged SA has inspected and tested the device for basic functionality and safety. Unless expressly stated otherwise on the invoice, the device is sold “as is” for cosmetic condition. Known conditions and any non‑functional items are disclosed below.
2. Warranty and CPA Rights
2.1 In line with the CPA, goods must be of good quality, in good working order, free of latent defects, and reasonably durable given their nature and price. If the product fails within 6 months due to a manufacturing defect, the consumer may choose a refund, replacement, or repair.
2.2 Because this is a pre‑loved device, normal cosmetic wear is accepted by the consumer and is excluded from warranty. Where expressly indicated and accepted by the consumer below, certain conditions may be sold on an “as is” basis for appearance only.
2.3 This limitation does not exclude liability for latent (hidden) defects known to Rugged SA and not disclosed, misrepresentation, or failure to meet basic safety standards.
3. Consumer Acknowledgments
I confirm I have read and understood the above disclosure before purchase.
I acknowledge this is a pre‑loved / used device and accept disclosed cosmetic wear.
I have reviewed the Condition & Known Defects table and agree to purchase on that basis.
I agree to the limited Warranty period of 3 months.
I understand my CPA rights remain in force for latent manufacturing defects.
I accept that cosmetic wear disclosed above is excluded from warranty.
I consent to Rugged SA processing my personal information for warranty/repair purposes in accordance with POPIA.
4. Acknowledgement
“I acknowledge that this is a pre‑loved / used device. I have read the product page disclosures and accept the disclosed cosmetic condition. I understand that there is a limited warranty of 3 months. My CPA rights remain in force for latent manufacturing defects.”
